MEDICAL RECORDS

TO OBTAIN COPIES OF YOUR MEDICAL RECORD(S):

bullet A patient’s original medical records are the property of the physician/medical organization. However, patients have a property right in a full, complete, and legible copy of their medical records. Physicians can legally and ethically charge a patient to cover the costs of copying records.
bullet If your physician is member of a group practice and leaves that practice, the medical records remain the property of the group practice. A copy of the patient’s medical record may be requested but be advised that there may be a charge.
bullet Physicians cannot withhold records until an outstanding bill is paid.
bullet In Missouri by statute, Section 191.227.1 a physician may withhold medical records "consistent with the patient’s condition and sound therapeutic treatment as determined by the physician." In other words, if there are items in records which if revealed to the patient would be detrimental to the patient, they may be withheld.
bullet There is no state statute which dictates how long medical records should be kept. The reality is that physicians should keep minors records until three years after their 21st birthday if the physician stays in the state. If the physician leaves the state, they should keep the records forever. With respect to adults, records should be kept for three years after the last date the patient was seen, unless the physician leaves the state in which case the records should be kept forever.
bullet In Missouri by statute to obtain your medical records, you must first make a written request; second pay the fee (in advance) which is $15 plus 35 cents per page for documents made on a standard photocopy machine. If the records are microfilmed, its $15 plus the actual cost of duplication.
bullet If your physician has left the area and you are unsure as to where you may find your medical records, you may call the Cape Girardeau County Area Medical Society at (573) 334-5691.
